By accessing and using GiftSong, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our service.

2. Service Description

GiftSong provides a platform for generating personalised songs based on user-provided lyrics and preferences. Our service includes:

Subscription-based access to song generation features
Storage and management of generated songs
User account management and authentication

3. User Accounts

To use our service, you must:

Be at least 13 years old
Register for an account with valid information
Maintain the security of your account credentials
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use

4. Marketing and Analytics Consent

By using our service, you consent to:

Marketing Communications: We may send you marketing emails about new features, special offers, updates, and promotional content related to GiftSong. You can unsubscribe from these emails at any time by clicking the unsubscribe link in any marketing email or by contacting us directly.
Analytics Tracking: We use cookies and analytics tools to collect information about how you use our service, including pages visited, features used, and interaction patterns. This helps us improve our service and provide personalized experiences.
Data Processing: Your consent allows us to process your data for marketing and analytics purposes in accordance with our Privacy Policy.

5. Subscription and Payments

Our service operates on a subscription basis:

Subscription fees are billed in advance on a monthly or annual basis
Monthly subscriptions can be cancelled at any time with no penalty
We reserve the right to modify subscription fees with 30 days notice
Subscription features are subject to change
Annual subscriptions represent a 12-month commitment (365 days) from the date of purchase or renewal

⚠️ Early Cancellation Policy for Annual Subscriptions

Annual subscriptions are sold at a discounted rate in exchange for a 12-month commitment period. If you wish to cancel your annual subscription before completing the full 12-month term, you are subject to an early cancellation fee.

How to Request Early Cancellation:

Send a written email request to support@giftsong.ai from the email address associated with your account
Include your account email and state your request for early cancellation
Our team will calculate and respond with your exact cancellation fee (typically within 2 business days)
You will receive an invoice for the cancellation fee
Once the fee is paid in full, your subscription will be terminated immediately

Cancellation Fee Calculation:

The cancellation fee equals 50% of the total value of all remaining months in your commitment period, calculated using the monthly equivalent rate.

The fee is calculated as: (Remaining Months) × (Monthly Rate) × 0.50
The calculation is based on calendar months remaining from your next renewal date
The fee is charged as a one-time payment (not recurring)

Important Points:

You cannot cancel through your account dashboard - you must contact support via email
There is no refund of any previously paid subscription fees
The cancellation fee must be paid in full before your subscription is terminated
Once cancelled, you will immediately lose access to all subscription features and will no longer be able to create new songs. However, you will retain access to view and download all previously created songs
This policy applies only to annual subscriptions. Monthly subscriptions can be cancelled anytime with no fee
If you're in the final 30 days of your annual subscription, the cancellation fee will still apply based on remaining time
GiftSong reserves the right to refuse early cancellation requests if fraudulent activity is suspected

6. Song Purchases and Refund Policy

When purchasing individual songs or unlocking full songs:

All customers have access to song samples before making a purchase
By purchasing a song, you acknowledge that you have listened to the available sample
No refunds will be provided if you are dissatisfied with the full song after purchase
You accept the risk that the complete song may not meet your expectations beyond what was demonstrated in the sample
All song purchases are final once the full song is unlocked and made available to you
This policy exists because you have the opportunity to evaluate the song quality through the provided sample before committing to purchase

Important: Please listen carefully to song samples and ensure you are satisfied with the quality and style before purchasing, as all sales are final.

7. User Content

By using our service, you agree that:

You own or have rights to the content you provide
Your content does not violate any laws or third-party rights
You grant us license to use your content for service provision
We may store and process your content to provide our service
You are responsible for any content you generate or share

8. Marketing, Analytics, and Data Sharing

By agreeing to our Terms of Service, you consent to:

Marketing Communications: We may send you marketing emails about new features, special offers, updates, and promotional content. You can unsubscribe from these emails at any time using the unsubscribe link provided in each email.
Analytics Tracking: We use cookies, tracking technologies, and analytics tools to improve our service, understand user behavior, and provide personalized experiences. This includes but is not limited to Google Analytics, Meta Pixel, and other third-party analytics services.
Third-Party Sharing: We may share your data with trusted third-party service providers who assist us in operating our service, including but not limited to:
- Payment processors (Stripe)

- Analytics platforms (Google Analytics, Meta)
- Cloud storage providers (Supabase)
- Customer support tools
